FALSE ADVERTISING LAWSUIT AGAINST SEAWORLD GIVEN GREEN LIGHT BY JUDGE

In the potentially precedent setting lawsuit “Anderson v SeaWorld”, federal Judge Jeffrey White has ruled against SeaWorld’s third attempt to have major portions of the consumer lawsuit dismissed, allowing the case to go forward to the discovery phase and trial.

The case challenges SeaWorld’s so-called “facts” about their orcas in captivity, contending that SeaWorld’s advertising and online statements about the welfare of captive orcas violate consumer protection and fair business practices laws. For example, one of the plaintiffs claims she was misled by SeaWorld trainers who told falsehoods including that captivity in general does not harm orcas.

Ultimately, the lawsuit seeks a court order requiring SeaWorld to cease making false statements about the health and welfare of the orcas and to make a factual public statement about the orcas, refuting previous false claims.

“SeaWorld would love for this lawsuit to go away so that they can continue to spread falsehoods to the public,” says David Philips, Director of the International Marine Mammal Project of Earth Island Institute. “But Judge White is sending a clear message to SeaWorld that, at the very least, their behavior warrants scrutiny.”

“If SeaWorld told the truth about the whales’ shortened and stressful lives in concrete tanks,” Dave Phillips added, “as well as the severe depression and boredom from sterile living conditions, the public would demand change.”

The International Marine Mammal Project has been acting as a key consultant in the lawsuit since its inception and advising the law firm of Covington & Burling LLP, which is conducting the lawsuit on a pro-bono basis.

Since the original case filing in April 2015, SeaWorld has filed three separate motions for the case to be dismissed. While some parts of the lawsuit have been dropped or modified in response to those three motions, Judge White has upheld the basic core of the case against SeaWorld so far.

The lawsuit will now enter the discovery phase, which will allow plaintiffs to seek information from SeaWorld’s records about the true welfare of captive orcas. A case schedule is expected to be set shortly.

In April 2010, the Deepwater Horizon oil spill changed the Gulf of Mexico in ways that we're still trying to understand. Over the course of 87 days, more than 134 million gallons of oil spilled into the sea. This kind of environmental disaster doesn't end when the cleanup crews head home; it's felt for many years beyond, and marine creatures like bottlenose dolphins are proving that point.

A new international assessment coordinated by the U.S. National Oceanic and Atmospheric Administration (NOAA) and many partners looked at more than five years of data and analysis to understand the long-term impacts of the spill on the health of marine mammals like dolphins and whales.

According to the study, the dolphin population in the Barataria Bay area of the Gulf will have suffered a 50 percent population drop in the decade following the spill. A full recovery is expected to take at least 40 years.

"Despite all the uncertainties, it is clear that many populations of marine mammal were badly affected by the oil spill, and that these negative effects will persist for many years into the future," says Dr. Len Thomas in a press release from University of St. Andrews — home of the Sea Mammal Research Unit (SMRU) and the Centre for Research into Ecological and Environmental Modelling (CREEM), both of which were partners in the research.

A special issue of Endangered Species Research (link is external), was published on Jan 31, 2017, and features 20 scientific articles that summarize the impacts of the 2010 Deepwater Horizon oil spill on marine mammals and sea turtles. The scientific studies, conducted by NOAA authors and partners, document the unprecedented mortality rate and long-term environmental impacts of the oil’s exposure and presents a synthesis of more than five years’ worth of data collection, analysis, and interpretation. Findings from these research studies, in addition to other studies on other parts of the ecosystem, formed the basis of the natural resources damage assessment settlement with BP for up to $8.8 billion.

All of the data associated with the settlement is available publicly in the Data Integration Visualization Exploration and Reporting (DIVER) database, but the Endangered Species Research special issue is the first time this information on sea turtles and marine mammals has been compiled together in peer-reviewed scientific publications.

SeaWorld Entertainment, Inc. has released its fourth quarter and full year of 2016 results – and once again, revenues and attendance are down.

According to a press release dated February 28, 2017, the company reported total revenues of $267.6 million versus $267.9 million in the fourth quarter 2015. A net loss of $11.9 million was recorded, compared to $11.0 million in the same quarter. Attendance was down by approximately 30,000 individuals. Full year 2016 results list total revenues at $1.34 billion in 2016, compared to $1.37 billion in 2015 – a decrease of $26.7 million. Net loss was recorded at $12.5 million. Total attendance declined by approximately 471,000 individuals.*

Why should people be inspired to protect animals when SeaWorld condones keeping dolphins in captivity?

It’s clear SeaWorld needs to acknowledge keeping dolphins and other whales in captivity is wrong. You can dress it up, dress it down, but in the end, the mammals have no more ability to make their own choices than the public does in choosing how much to pay for their admission. It’s hard to generate empathy for their plight when “environmentally-friendly” scripts are recited over glass and concrete tanks. And again we ask, experiences that matter – to whom?

Imagine how far three months of SeaWorld’s revenues could go towards protecting dolphins and other whales. The implications are staggering: SeaWorld could invest in state-of-the-art retirement facilities for their current roster of performing/non-performing cetaceans; could be an environmental leader in cleaning up and preserving the mammals’ natural ocean habitats; and lead a movement against any businesses that engage in drive fisheries and/or offshore whaling. They could create educational programs for all ages, utilizing revolutionary technologies that would TRULY serve to inspire.

Our message to SeaWorld

With a commitment to compassion, public support could turn SeaWorld’s numbers around. After decades of profits literally earned on the backs of these mammals, think about it…

The time is NOW to put the “sea” back into the world of dolphins and other whales.
