VING allowed to seize private guns and ammo?!?!

Are you kidding me? Another good reason not to register a gun! Is this even lawful?

Probably legal during a state of emergency, like curfews and marshal law.

If & when they come for your gun(s), just hide them well and claim you took them to the states and sold them....

If the pdf file linked on that page is authentic, it says "...The Adjutant General is authorized and DIRECTED to seize arms..."

that is written in to the emergency act, but it's not being leveraged. I'm sitting right next to the FEMA and national guard control cells, no talk of anything like that is going around.

I'm sure that was just the language that was pre written for declaring a state of emergency. (not to say people shouldn't raise their concerns about it, just don't see it as written specifically for this situation alone).

The reference PDF looks like the official signed order. Makes sense that it's just standard verbiage as LF stated.

Montana is an open carry state. In the VI, it is difficult to get a license to legally own a gun. I'm not sure whose guns will be taken.

There was considerable lawlessness in the VI post Marilyn and post Hugo.

Can you imagine this even being considered in say, Montana?

Only the ones that have an address--how do you think a bunch of these weapons end up being stolen within days of licensing? All the more reason not to get on a "list". You think they gonna start in the projects door to door for illegal weapons. chuups

I lived on STX for almost 6 years and had a loaded pistol in my home that I never registered. I brought the pistol to STX per AA guidelines. I filled out the declaration of a firearm form, plus the unloaded pistol was in a locked gun case. The ammo was sent separate on another trip in ck'd luggage. The sole reason I did not register it was I had several of my friends that registered their weapons only to have them stolen in a home break-in a few weeks or months later.

Fortunately I never had to use it plus we never had any unwanted intruders aka "thiefs" in our home.

Well of course they would, after Marilyn in Stt the Natl Guard armory was looted and they took every gun a bit of ammo in the place..... every now and again they recover one of the guns but that is kept very hush hush

I see nowhere in credible journalism where this Order of seizure was actually issued. All right wing whacko websites repeating the story until, as always, it becomes "truth." Frankly, I wouldn't put it past Mapp, but a reasonably credible source would be helpful. Currently, there are none.

I'll say. Talks about a lot of hype over nothing. So Mapp says neither he nor the VING is authorized to seize private property from private citizens. His order directs the VING to get whatever they need on the open market (pay for it) without having to go through the normal required government procurement and appropriations process.

This is true.

However he's just using the existing language of the law.

Virgin Islands Code

TITLE TWENTY-THREE Internal Security and Public Order
Chapter 19. National Guard
Subchapter I. General Provisions

23 V.I.C. § 1522 (2017)

§ 1522. Authority of Governor for the attachment of articles and to order the closing of establishments

Whenever the Governor orders part or all of the military forces of the Virgin Islands into Territorial Active Military Service under section 1519 he may, by written order--

(1) Direct the Adjutant General or other appropriate authority to seize arms, ammunition, explosives, incendiary material, and any other property that may be required by the military forces.

(2) Prohibit the sale, exchange, loan or donation, during the emergency of arms, ammunition, explosives, gasoline, incendiary material or alcoholic beverages, and the closing of any establishment in which any such property is found.

(3) Declare a curfew, during such periods and with respect to such areas and persons as in his discretion the public safety requires.

(4) Any other powers authorized by law.

Upon termination of the emergency, compensation shall be paid by the Government of the Virgin Islands for the loss, damage, or destruction of any private property taken for Government purposes during the emergency.

HISTORY: --Added Feb. 8, 1973, No. 3363, § 1, Sess. L. 1972, p. 558.

Notice the last part about compensation that wasn't re-iterated in is latest order but still valid. Still seems to contradict his earlier statements that it's not legal for them to take private property unless it's qualified with seizing without compensation.
