accident on smith bay road

...last night, just at the entrance to Point Pleasant: That was me. Guy swerved into my lane and hit me head-on. We're all ok, except my chest really hurts from the seat belt. Thank god the people behind him stayed to give witness account to the cops.

I was driving a rental car, and cop said the guy has insurance but wondering if I should get a lawyer just in case?

Thoughts?

You get a lawyer only if and when you need one in case of a dispute with the insurance company. If you weren't checked by a medical professional you should do so immediately and have your injuries documented. If you're staying on the East end the easiest place to get to is the Red Hook Family Practice. Also get a copy of the police report which will cost you a couple of $$s and which you pick up when it's ready at the courthouse in town.

Glad you're OK!! - Terrifying. I agree with OT for sure, CYA and get a medical check out and police report. I always fear head on's in STT. I got side swiped by someone on STT once, luckily they only got my mirror and when we started to exchange information they got spooked and took off. She looked way under age and I suspect parents didn't know she had the car. I called the cops just to report that I was not the one who hit and ran.

We did everything by the book. The only thing that didn't happen was a breathalyzer test, but even if the guy had been drinking, I worry about nepotism here on the island. I was at the hospital for 4 hours yesterday - my sternum is fractured. The airbags in the rental car did not deploy and they really should have - I was going about 35 mph and he had to have been going at least that fast for the impact to have cracked solid bone, and I don't remember if I hit the steering wheel, or if the seatbelt did the damage . It's tremendously painful, but I am happy to report that I received wonderful care at Schneider - efficient ER with a good staff.

None of this pales my adoration of this island at all. We still think buying the place was the best thing we've ever done and are looking forward to many happy years here. <3 STT <3

I'm glad you are (somewhat) okay, too! The only problem with the guy having insurance is that I think the limit is $10,000 for basic liability. A truck driver took down the historical cover at Market Square several years ago and that was all the insurance he had. Of course it was a million or so to fix it. Did your guy get ticketed?

Since you were driving a rental, assume you've spoken to the agency to find out what you're personally covered for under their insurance?

The only thing I'm covered for under the car rental insurance is collision, which is great and no more than I expected. Otherwise we would have had to pay for the entire car out of pocket and deal with the insurance ourselves.

Part of me wants to go after Toyota over the airbags because that was not cool. My husband is a HUGE man - almost 6'7" and we were in a Yaris...seriously lucky his head didn't christen the windshield.

I don't know if the guy was ticketed. I wasn't watching. Judging by the position of the cars and the witness statements of the two guys who stopped and stayed with us the entire time (thank you so so much) I assume he was?

I would say lawyer up. Fractured sternum is not a joke. Airbag should have fired up at frontal impact even at 15 mph. You do have a case here given Takata recall especially since it was a rental car so car rental agency will share into liability.

Never assume anything. I had a guy hit me and I was given the ticket. (I fought it and won).

Yeah - hubs is now back in NYC and is on it. I head back this afternoon and will start researching in earnest. the last 72 hours have been devoted to some seriously good painkillers. 😉
