There is a new post about not being able to ship a car with over 100,000 miles on it to the USVI. On one of your posts you had mentioned that you were going to ship an older S10 truck. Did you ship it and was there a millage restriction on it?

Lizard. I have come to realize you are either a retired Attorney or Judge or it could be that you just like doing damn good research.
Question ? In the Virgin islands law,does a vehicle count as an extension of your home ?

I just shake my head when I see the hoopties running around with a current inspection sticker ..... just another scam to lighten your wallet

The Answers Yes and No. If you drive a vehicle registered in the USVI with an upper 50 State license it would not be considered as an extension of your home, so your 4Th Amendment Rghts would not be violated. Also a warrant for probable cause is a phone call away. The Legislature of the Virgin Islands granted and Expanded jurisdiction to the Territorial Court, now Known as the Superior Court in 1993 pursuant to 4 V.I. Code Ann&76. This Court issues warrants for Person, Home, and Vehicle. Here is the difference with Upper states laws and VI Laws as it pertains to warrantless searches of a motor vehicle. A VIPD Police Officer Stops you for just cause or suspicion of Probability (Probable Cause) which carries a broad legal definition. They the police can search a vehicle without your permission and warrantless(United States, 267 U.S. 132). Now whether anything found can be used as evidence in court is a different matter. The Police Officer has the option to proceed as he/she sees fit regarding a warrant. If it's a simple DWI/DUI he/she will more than likely proceed warrantless. They may also impound the car for inventory awaiting a Warrant.

Thanks Lizard. If they pull me over all they will find is a knife in my pocket and a registered hand gun. So a person who lives in the VI with a VI address, and all other required local paper work. "Should" not get into any legal trouble from the local authorities,if that person was to protect his or her personal property while visiting their favorite beach ?

You would need a permit to carry for that. You can use a registered gun for at home in the home protection. Unless you have a permit to carry you can only transport your gun unloaded to and from a range in your vehicle. The VI Law is specific about that.

Thanks Lizard. I will have all required permits. Credit card receipts,Cash and making Bank deposits,my butt will be covered legally and otherwise.
