Open Fields and backyards do not fall under the search and seizure laws, no Probable Cause or Warrants are required. The outside of ones home does not violate your 4Th Amendment Rights. It was the (State of Vermont Supreme Court that made your referenced ruling) not the US Supreme Court. So if the authorities are looking to see whats growing in you backyard you have a problem. Try to keep your plants on the window sill, oops sorry that's probable cause.

I really thought that they had heat sensors for the drug raids - to see if one area was producing more heat than another to find patches of pot plants.

That is for indoor growing. Outdoor can be seen (due to different coloration) from an aerial vehicle.

Edit: infrared heat sensors for locating indoor growing is illegal. Mostly, in the States, they use them for locating fleeing subjects and any info (locating possible grow rooms) can be used to issue warrants. It is really a very vague sense of finding growers.

While open fields are not protected by the Fourth Amendment, the curtilage, or outdoor area immediately surrounding the home, is protected.....sorry your yard is protected! But if they want to confiscate my pepper & tomato plants.....by all means have at it!
Also daisies, fragipani (sp), 3 o'clocks & assorted flowers...........

The U S Supreme Court has ruled that " in the case of open fields,curtilage, the general rights of the property protected by common law trespass have little or no relevance to the applicability of the Fourth Amendment. (United States vs Dunn.) So there goes the protected yard theory.

yeah, pretty much since 9/11 individual rights have faded in this arena. evidence found after an illegal search is often still admissable. Allowing for profiling and helicopter flyovers.

Military uses them for training exerises as well. They own a big chunk of land over on the far east, southern shore. So sometimes they're doin exercises over here.

Oh well.........yard smard...rights smights............. I personally have no worries, but still think the money blown on this kind of stuff could be better spent here..........roads, education, trash pick up.......but thats just my opinion.

yeah, no worries either...but the misuse of $$$$, imo...and those guys have to put their lives on the line, for what?

I have to smile about all the statements about misuse of dollars, waste of time, they can't do that. Not one poster even knows what they (the helicopters were doing)! They could have been taking pictures for topo maps or some other cause or program! Maybe some of you free the weed guys are getting a little paranoid

Lizard, after seeing this waste of funds for the 11th year in a row, it has nothing to do with paranoia, i happen to know what they are doing and I think other folks do to. if you disagree and feel this is appropriate use of your tax dollars, fine, to each his own, but don't assume we don't know what we are talking about. This had nothing to do with taking map photos and probably in a couple days you'll see the typical news story on how many millions of street dollars in weed they pulled up. i bet you won't hear of an arrest though.

Your claim "You Know" maybe you should share that information to support your claim. Is it ATF,CIA,FBI,VIPD,NSI,NSA,USMF,HLS? You know as a fact tax dollars are funding this operation. I assume nothing! But I do smile!

I noticed helicopter around Salt River and Northshore on Wednesday and thought that they were taking arial photos that they send you a sample of in mail and then hope you buy. They circled my villa and there was a guy with camera who took photos as they circled overhead.. I was standing out on the deck watching him. Are you sure that is not what they were doing????

I have $20 that says Lizard regularly abuses alcohol, but he does not see that alcohol is far worse than marijuana, yet alcohol is legal.

Go ahead, Lizard - ask me to cite sources concerning marijuana vs. alcohol, or even worse, tobacco vs. anything.

Lizard, you are a detriment to the gene pool.

Lizard, you say you assume nothing but you say, "Not one poster even knows what they (the helicopters were doing)!" Like I said, after 11 years living here I do know what they are doing. It's not place to post on a public forum who is doing what. i would not want to put anyone's safety in jeopardy. If you don't believe me and think noOne here knows anyting. the 3000 or so free black plant containers I picked up this week from "their" drop spot is proof enough to me that they have been raiding fields.

I know you've been around this forum. Do you even live in STX. Have you not seen the Avis articles every year about this roundup. i really doubt military helicopters, hovering low over homes and fields, followed by a reckless driving convoy of humvees, ATV, and broncos are out here to take topo maps.

Do you really think this had nothing to do with raiding ganja farms???

Military Helicopters are not black! Like I said, I do smile. I didn't think they made broncos anymore! What are you going to do with 3000 or so black containers (who is "their"drop spot)? I would not want to put any ones safety in jeopardy , "give me a break"! Oh and yes I do live in STX not on the island now, not that where I live matters.

I was not asking what happened in 2006! I was asking about your inside information on whats happening now! Again I don't know who or what agency these helicopters come from, and I will not "assume" anything. What part of my statements confuse you the most.
